Below are answers to common questions regarding the Flat-Fee Agreed Divorce Service.

Do I have an Agreed Divorce?

An Agreed Divorce requires that you and your spouse (a) agree to proceed with a divorce, and (b) agree to all of the terms for your divorce. This means that you and your spouse agree to the division of property and debts, conservatorship (or “custody”) of the children, visitation with the children, and support of the children.

If you and your spouse meet these requirements, we can assist you with an Agreed Divorce Service.

Not sure if you have an Agreed Divorce, but not quite ready to put an attorney on retainer?

We know that you may not be sure if your case will be agreed, or you may want assistance on a “service by service” basis, rather than a package. We offer à la carte services which allows you to pick and choose which services you want us to assist with. The à la carte services also allow you to pay for one service at a time, rather than a package, if that is preferred.

What if my spouse and I have agreed to non-standard, or custom terms?

Our standard Agreed Divorce Packages include standard divorce decrees without custom provisions. If you and your spouse have agreed to custom terms related to property or children, we have “add-on services” available that can be added to your standard Agreed Divorce Package. The add-on services are also Flat Fee (no surprises fees later!) and are added to the applicable Agreed Divorce Package.

How long does it take to finalize my divorce?

In Texas, there is a 60-day waiting period from the date your case is filed before the Judge can review your case, grant your divorce, and sign your divorce decree. In most cases, we can finalize your case immediately after the 60-day waiting period.

Do I have to go to Court to file or finalize my divorce?

Most courts allow us to finalize divorce cases without making a court appearance. Instead, you can sign an affidavit that we will submit with your divorce decree, and in most instances, the Court will accept this affidavit in lieu of an in-person court appearance. There are a few courts that will require a Zoom or in-person appearance to finalize your case, but these are few and far between.
