The Legal Standard for Modifying a Texas Family Order

Texas family courts don’t grant modifications simply because one party prefers different terms. The petitioning party must demonstrate a material and substantial change in circumstances since the most recent order was entered. That standard gives court orders stability while still allowing families to seek relief when real life demands it.

Common changes that courts have found qualifying include:

A significant increase or decrease in either parent’s income
A parent’s relocation that affects the existing possession and access schedule
A change in the child’s health or educational needs
A meaningful shift in a parent’s ability to provide a stable home
Remarriage or new family dynamics that affect the child’s environment

Under the Texas Family Code, a child who is 12 or older may express a residential preference directly to the court. Judges consider that preference, though it doesn’t automatically determine the outcome. Conservatorship & Possession Orders

A conservatorship modification can change which parent serves as primary conservator, adjust the Standard Possession Order schedule, or alter how major decisions about the child’s education, healthcare, and welfare are made. Child Support Modifications

Texas child support guidelines are calculated based on the paying parent’s net resources. Spousal Maintenance Modifications

Spousal maintenance orders can be modified or terminated when the paying spouse experiences a substantial change in income or employment. Under the Texas Family Code, if the recipient spouse remarries, the maintenance obligation terminates automatically. If the recipient begins cohabitating with a romantic partner on a continuing basis, the court can order termination after a hearing.
